Dear Mr. Mickle:

Per our conversation on March 14, 2002, enclosed are the agreements between the City of Titusville and the Cypress Woods subdivision.

In 1991 the developer initiated an agreement with the City of Titusville concerning sewer availability to Cypress Woods.  This agreement contained a clause rendering it null and void if the water and sewer lines were not extended within two years.  The terms of the agreement were not met and the agreement was renegotiated in 1994.  The 1994 agreement did not contain annexation verbiage.

I would like to point out that the service availability area and the future boundaries for the City of Titusville are from Parrish Road in the north to Kings Highway/Ranch Road in the south.  Please note that the agreements indicated we would not provide services south of Kings Highway/Ranch Road.

It is important to recognize that the Port St. John incorporation area, which was studied and sent to the state, used this same boundary of Kings Highway/Ranch Road.

I hope this information will be of help to you.

                                                                                    Very truly yours,

                                                                                    Ronald G. Swank, Mayor
